Consumer Web Application. Food-Drug Interaction Screening

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING MEDPLATE. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE MEDPLATE.


1. Agreement to These Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and A3HCS, doing business as MedPlate ("Company," "we," "us," or "our"), governing your access to and use of the MedPlate web application and related services (collectively, the "Service").

By creating an account, accessing the Service, or clicking to accept these Terms, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

We may update these Terms at any time. We will notify you of material changes by posting an updated version with a revised effective date. Continued use of the Service after updates constitutes acceptance of the revised Terms.


2. The Service

MedPlate is a consumer informational web application that helps users identify potential food-drug interactions. The Service allows users to:

  • Maintain a personal medication list within their account
  • Submit photographs of meals or grocery items for AI-powered food identification
  • Receive severity-coded alerts regarding potential interactions between identified foods and medications on their list
  • Access an expanded scan quota and larger medication list capacity through an optional paid subscription

MedPlate is an informational tool only. It does not provide medical advice, diagnosis, or treatment. Users are instructed to consult a licensed pharmacist or physician before making changes to their diet or medication routine. See our Medical Disclaimer for full terms.

The Service is available at https://medplate.io and may be updated, modified, or discontinued at our discretion without prior notice.


3. Eligibility

You must be at least 18 years of age to create an account and use the Service independently. Users between the ages of 13 and 17 may use the Service only with verifiable parental or guardian consent. We do not knowingly permit users under 13 to register. If we learn that a user under 13 has created an account, we will delete it promptly.

By using the Service, you represent and warrant that: (1) you have the legal capacity to enter into these Terms; (2) you are not prohibited by applicable law from using the Service; and (3) all information you provide is accurate and current.


4. Account Registration

You must create an account to access the Service. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and not share account access with others
  • Notify us immediately at niteshmd@brainrevives.com if you suspect unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.


5. Medication List. User Responsibility

The food-drug interaction screening feature depends entirely on the accuracy of your medication list. You are solely responsible for:

  • Entering all medications, including prescription drugs, over-the-counter medications, vitamins, and herbal supplements
  • Keeping your medication list current as your prescriptions change
  • Verifying interaction alerts with a licensed pharmacist or physician before acting on them

MedPlate does not access pharmacy systems, electronic health records, or prescriber databases. We have no ability to verify or update your medication list independently.


6. Subscription Plans and Billing

6a. Free Tier

MedPlate offers a free tier that includes a limited number of scans per billing period and a maximum medication list size. Free tier limits are subject to change with notice.

6b. Paid Subscription

MedPlate offers an optional paid subscription that provides expanded scan limits and a larger medication list capacity. By subscribing, you agree to:

  • Pay the applicable subscription fee on a recurring basis (monthly or annual, as selected)
  • Authorize us or our payment processor (Stripe) to charge your payment method on file
  • Provide accurate and current billing information

6c. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods unless required by applicable law.

6d. Price Changes

We reserve the right to modify subscription pricing with at least 30 days advance notice. Continued use after the effective date of a price change constitutes acceptance.


7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to the MedPlate name, logo, software, food-drug interaction database, AI models, UI design, and documentation (collectively, "Content"), are owned by or licensed to A3HCS and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to your compliance with these Terms. You may not:

  • Copy, reproduce, modify, distribute, or create derivative works from any Content
  • Reverse engineer, decompile, or disassemble any software component of the Service
  • Scrape, crawl, or systematically extract data from the Service
  • Use the Service or any Content for commercial purposes without our express written consent
  • Remove or obscure any copyright, trademark, or other proprietary notices

8. User Submissions

By submitting photos, feedback, or other content to the Service ("Submissions"), you grant A3HCS a non-exclusive, worldwide, royalty-free license to use, process, and analyze your Submissions for the purpose of providing and improving the Service. You retain ownership of your Submissions.

You represent and warrant that your Submissions: (a) do not infringe any third-party rights; (b) do not contain personal information of individuals who have not consented to such submission; and (c) comply with applicable law.


9. Prohibited Activities

You may not use the Service for any purpose other than lawful personal use. You agree not to:

  • Use the Service to obtain clinical diagnoses, treatment recommendations, or prescriptions
  • Rely on interaction alerts as a substitute for consultation with a licensed healthcare provider or pharmacist
  • Attempt to access accounts, data, or systems belonging to other users
  • Circumvent or disable any security feature, rate limit, or access control
  • Upload malware, viruses, or other harmful code
  • Use automated tools, bots, scripts, or scrapers to access or collect data from the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Engage in any activity that disrupts or impairs Service performance or availability
  • Use the Service to build a competing product or service
  • Violate any applicable law or regulation

10. Medical Disclaimer and Limitation of Service

MedPlate is not a medical device, diagnostic tool, or clinical decision support system. The Service has not been cleared or approved by the U.S. Food and Drug Administration. Interaction alerts are generated by automated database matching and AI analysis and are not reviewed by a licensed clinician in real time.

THE SERVICE DOES NOT CONSTITUTE MEDICAL ADVICE. The absence of an alert does not confirm that a food is safe for you to consume with your medications. Always consult a licensed pharmacist or physician before making changes to your diet or medication routine.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, A3HCS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: (1) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (2) WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF INTERACTION ALERTS, FOOD IDENTIFICATION, OR DATABASE CONTENT; AND (3) WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.


12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, A3HCS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: (1) DAMAGES ARISING FROM RELIANCE ON INTERACTION ALERTS OR FOOD IDENTIFICATION OUTPUTS; (2) DAMAGES ARISING FROM DECISIONS MADE ABOUT DIET OR MEDICATION BASED ON SERVICE OUTPUTS; (3) LOSS OF DATA, REVENUE, OR PROFIT; OR (4) PERSONAL INJURY OR PROPERTY DAMAGE OF ANY KIND.

IN NO EVENT SHALL A3HCS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO A3HCS IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. If such laws apply to you, some or all of the above limitations may not apply, and you may have additional rights.


13. Indemnification

You agree to defend, indemnify, and hold harmless A3HCS and its officers, directors, employees, agents, and licensors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (1) your use of the Service; (2) your violation of these Terms; (3) your Submissions; or (4) your violation of any applicable law or third-party rights.


14. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.

Provisions that by their nature should survive termination will survive, including: intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.


15. Modifications and Interruptions

We may modify, suspend, or discontinue any aspect of the Service at any time without liability. We are not obligated to provide any updates, corrections, or new features. We will use reasonable efforts to provide notice of planned maintenance that may affect Service availability.


16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any dispute not resolved through informal negotiation or arbitration shall be subject to the exclusive jurisdiction of the state and federal courts located in Lake County, Illinois.


17. Dispute Resolution

17a. Informal Resolution

Before initiating any formal dispute process, you agree to contact us at niteshmd@medplate.io and allow 30 days for us to attempt informal resolution. Most concerns can be resolved quickly through direct communication.

17b. Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English. The seat of arbitration shall be Lake County, Illinois. The number of arbitrators shall be one (1). The arbitrator's decision shall be final and binding.

17c. Class Action Waiver

YOU AND A3HCS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

17d. Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to protect confidential information.


18. Electronic Communications

By using the Service, you consent to receive electronic communications from us, including account notices, billing receipts, policy updates, and security alerts. Electronic communications satisfy any requirement that such communications be in writing.


19. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, Cookie Policy, and Medical Disclaimer, constitute the entire agreement between you and A3HCS regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: We may assign our rights and obligations without restriction. You may not assign your rights without our prior written consent.
  • Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control.
